Fatal Accidents Act – Bereavement Damages Review
Section 8 of the Fatal Accidents Act allows certain family members of a deceased individual killed by a wrongdoer, the right to claim compensation from that wrongdoer for grief and loss of companionship. This compensation is referred to as bereavement damages.
Section 9 of the Act requires the government to review, and potentially adjust, the bereavement amounts every five years. The 2012 review is underway, and a discussion paper was prepared to invite comments on the amounts.
The consultation ran from June 1-29, 2012 and is now closed. The government is reviewing the comments received.
