When asked to decide how much child support is payable, the courts can look at the parents’ individual circumstances. Judges often decide to use the tables in the child support guidelines to set child support amounts, but they can also decide not to use those tables in some cases. The guidelines discuss when a judge might decide to depart from the table amount, including when children are over 18 and where “undue hardship” is found for either parent.
